Aren't Bitmain's legal obligations best represented by protecting their 1M BCH coins?
I have no idea. For all I know, CSW's plan may be (or perceived to be) the best way to protect those coins. Also, agreements are agreements. The letter of the agreement counts.
Now, I suppose you would (and I would too) be curious to know why the stockholders can not just agree with Bitmain to change agreements. But the claim is not yet disproven to me
