Yeah but from what I understand the hard limit is 32MB for every miner (all implementations)... so 32MB will be accepted by all miners... no risk of orphan...
Not quite. The hard limit is 32mb but the risk of orphan is still not zero. If a miner is having trouble technically processing a block, they will have to orphan it to keep mining.
