We already have consensus that we want to work on the system so it will be able to scale past blocks of 22 MB big. So everybody in BCH wants a solution, or do you disagree?
People said the same about SegWit.

the issue is that a lot of people will complain about which fork is the one that was referred to in the contract if it is not written correctly
