Well I'm sure Craig would've preferred if things had unfolded differently. BTC should've never been allowed to get this big. It's possible he lost the keys to the earliest coins, but I think he's probably just waiting for the Kleiman case to be resolved.
It appears Craig sold over 60 million worth of BTC last year. They were Satoshi era coins from 2010 though, so the sale didn't set off too many alarms. I expect the 2009 coins to be the last to move, but you're right, it's kind of like a game of jenga.
The moment he did that, his BTC holdings would plummet. Any intelligent person would liquidate as much of their BTC as possible, before dropping a bomb like that. If he liquidates before the Kleiman case is resolved, he could face bigger problems.
